Terms and Conditions of Supply of Wastewater Treatment System & Rainwater Harvesting Systems Only

Eco-Septic Pty Ltd, Raincycle and Econocycle Service 

Please read these terms and conditions carefully. These terms and conditions may have changed since your last visit to this site. By using this site, you acknowledge acceptance of these terms and conditions.

  1. Scope

All goods and services supplied by Eco-Septic Pty Ltd (“the Supplier”) are supplied on these terms and conditions.

    2. Supply of Goods

  • All supplies of goods and/or services by the Supplier to the Customer during the term of this agreement will be on the terms and conditions herein.
  • No other terms and conditions will apply to the supplies of goods and/or services by the Supplier unless they are accepted in writing by the Supplier.
  • The Customer acknowledges that the Supplier’s supply of goods and/or services is subject to availability at the time of ordering.
  • The Supplier will not be liable in any circumstances for failure to supply any goods and/or services ordered by the Customer.
  • The Supplier reserves the right to discontinue any product or change its design at any time.
  • In the event of the discontinuance or change in design of goods, the Supplier is not liable for the supply of any outdated goods. The Customer may update to the new model at their own cost.
  • Property in any goods delivered to the Customer will not pass to the Customer until payment in full for the goods and services is made to the Supplier as set out in the tax invoice.
  1. Orders
  • The Customer must submit an order directly to the Supplier.
  • Any Customer Order submitted by the Customer to the Supplier will constitute an offer on the terms and conditions of this agreement, as amended or supplemented by the express terms of the Customer Order.
  • If the Supplier accepts an order, the Supplier and the Customer will be contractually bound to complete the order in accordance with the terms and conditions herein.
  • Upon payment of the tax invoice, the Supplier will arrange the dispatch date and the goods to be removed from the holding yard and delivered to the delivery address (‘the site’) within 14 days subject to clause 4.
  1. Payment
  • All credit orders are accepted by the Supplier subject to satisfactory credit approval of the Customer and are governed by the Supplier’s credit terms and conditions in force at the time of order placement, including the right to charge interest. Credit approval once granted may be withdrawn at any time.
  • Payment must be made in full without set-off or deduction before the goods are dispatched. The Supplier will investigate any disputed amounts, and if resolved in favour of the Customer, a credit will be issued to the Customer.
  • The Supplier reserves the right to charge Card Surcharges in the event payments are made using a credit, debit, or charge card including Visa, MasterCard, American Express.
  • All prices quoted by the Supplier will be firm for 30 days from the date of the quote.
  • Payment for material, goods, and services pursuant to this agreement, including GST, is due on the last day of the month following the month in which the goods were delivered or services provided unless otherwise stated in writing by the Supplier.
  • The Supplier reserves the right to change the price of the goods without prior notice to the Customer.
  • After the due date of payment, the Supplier may charge interest on outstanding amounts payable, calculated on a daily balance, at the reference rate of our nominated Banking Corporation +2%.
  • The Customer agrees to pay and reimburse the Supplier on demand for all legal costs, stamp duty, or other costs or expenses suffered or incurred by the Supplier concerning the sale of goods or supply of services.
  1. Delivery
  • The Supplier will make all reasonable efforts to deliver the goods to the site at the agreed time and date but will not be liable for any losses incurred by the Customer or the installer due to delays.
  • Delivery and unloading of goods are at the truck driver’s discretion. The Supplier reserves the right to cancel the order if the site conditions are unsafe.
  • The Customer must ensure the site is prepared for delivery, including necessary equipment such as an excavator or crane.
  • Risk in the goods passes to the Customer upon delivery to the site or upon pickup from the Supplier’s holding yard.
  1. Cancellations
  • Cancellations require 24 hours’ written notice before 10:00 AM the day before the scheduled delivery.
  1. Price
  • Unless otherwise agreed in writing, the price for the goods and services shall be that listed by the Supplier at the date of order on its invoice. Prices are inclusive of GST.
  • Customers are responsible for:
    • Council approvals and permits.
    • Site preparation, excavation, and backfilling.
    • Irrigation and land application area preparation.
    • Sewer connections by a licensed plumber.
    • Power connection by a licensed electrician.
  • Tanks must be lifted and installed as per Eco-Septic tanks installation and excavation details.
  1. Responsibility to Notify
  • It is the responsibility of the Customer to notify the Supplier concerning the commissioning of the system on the property.
  1. Change of Ownership
  • If the Customer’s business ownership changes, the Customer remains liable for all debts incurred on the account until the Supplier is notified in writing.
  1. Limitation of Liability
  • The Supplier provides no express or implied warranties regarding the goods supplied.
  • The Supplier’s liability is limited to:
    • Replacement or repair of goods.
    • Reimbursement for equivalent goods or repair costs.
  • The Supplier is not liable for indirect losses, damages, or consequential losses arising from the use of the goods.
  1. Exercise of Legal Rights
  • Failure to enforce any provision does not constitute a waiver of rights under these Terms and Conditions.
  1. Governing Law
  • These Terms and Conditions shall be governed by the laws of Victoria, Australia, and the parties submit to the jurisdiction of the courts in that state.
  1. Severability
  • If any provision of these Terms and Conditions is deemed unlawful or unenforceable, that provision shall be severed, and all other provisions shall remain in effect to the fullest extent permitted by law.

 

IMPORTANT WARRANTY REQUIREMENTS

  • Installation must be supervised by a qualified representative of the purchaser.
  • Photographs of the backfill process must be uploaded with this registration, especially for poly tanks. Without these photos, the warranty is void.
